TITLE 18 SUBDIVISION REGULATION
Chapter 18.30 REQUIREMENTS AND PROCEDURES FOR SUBMITTAL OF A PRELIMINARY PLAT
18.30.800 Action of the planning and zoning commission and the city commission.
The planning and zoning commission and the city commission will review, at
separate public hearings, the plat, reports, recommendations and comments from
the city, other agencies, the applicant and interested
citizens.
A. Resolution for Approval. If the planning and zoning commission
approves the preliminary plat, said plat will be deemed to be in conformity with
the standards set forth in these regulations and the Clovis comprehensive plan
and will be referred to the city commission. If the city commission approves the
preliminary plat, said plat is deemed in conformity with the standards set forth
in these regulations and the Clovis comprehensive plan.
B. Motion for
Postponement. If the planning and zoning commission postpones action on the
preliminary plat pending additional information, the said plat will be
reconsidered by the planning and zoning commission at the next regularly
scheduled meeting. Upon consideration the planning and zoning commission may
approve, disapprove or grant conditional approval. If the city commission
postpones action on the preliminary plat, said plat will be reconsidered by the
city commission at a regularly scheduled meeting provided all provisions as
specifically outlined by the city commission have been complied with by the
applicant.
C. Disapproval. If the planning and zoning commission elects to
disapprove the plat, the plat is deemed not to be in conformity with the
standards or the intent as set forth in these regulations and the Clovis
comprehensive plan. The planning and zoning commission will send its
recommendations to the city commission. If the city commission elects to
disapprove the plat, the plat is deemed not to be in conformity with the
standards or the intent as set forth in these regulations and the Clovis
comprehensive plan. Whenever a plat has been denied by the city commission, then
the planning and zoning commission will not reconsider said plat for a period of
one year from the city commission’s action of disapproval. Provided,
however, that if in the opinion of the city, the plat is modified to overcome
the stated objections, then the planning and zoning commission and the city
commission will consider said plat within the one year
limitation.
D. Conditional Approval. The planning and zoning commission
and/or the city commission may elect to approve the plat subject to certain
conditions or provisions.
E. Notification. The applicant will be notified by
the city by letter of the action taken by the planning and zoning commission and
by the city commission. The letter will include any changes or recommendations
as indicated at the public hearing. (Ord. 1606-99 § 2(part),
