17.80.240 Termination by abandonment.

A. All nonconforming uses shall be deemed terminated if abandoned. Rules to determine abandonment are:
1. Any nonconforming use, structure or sign, the use of which is discontinued for a consecutive period of time as specified in this section, regardless of any intent to resume or not to abandon such use, is considered abandoned. The nonconformity cannot be reestablished except in full compliance with this title.
2. Any period of discontinuance caused by government actions, strikes or material shortages and without any contributing fault by the nonconforming user, shall not be considered in calculating the length of discontinuance.
3. If the abandonment is due to the use’s partial destruction, it is subject to the requirements of this section. If the nonconformity may legally be rebuilt, it shall not be considered abandoned if this section’s requirements are met.
B. Abandonment shall require the use, lot or structure to be abandoned for a period of one hundred eighty days. For signs, the abandonment period is sixty days.
C. Any nonconforming sign relating to a business on the premises on which it is located shall be terminated upon any change in the text of said sign or issuing a zoning permit for a change in use.
D. Any partially destroyed nonconforming use, sign or structure shall be considered abandoned if action is not initiated to have it inspected to determine if it can be rebuilt within thirty working days of the destruction date. (Ord. 1495-96 § 3(part), 1996).
