17.100.315 Administrative appeal standards.

The purpose of the appeal is to determine if the original decision met the requirements of this title. The body hearing the appeal is limited to the following determinations:
A. The decision maker made an error in reviewing whether a standard was met. The record must indicate that there was an error in judgment, or misreading of facts, plans or regulations in determining whether this standard was met.
B. Where conflicting evidence exists, the appeal is limited to determining what evidence or testimony bears the greatest credibility.
C. The decision maker made the decision on standards not contained in this or other city ordinances, regulations or state law; or a standard was applied more strictly or broadly than is appropriate to implement the comprehensive plan and this title. This title does not permit administrative decision makers to consider or create standards that are not officially adopted.
D. The decision maker made an error in applying a standard or measuring a standard. (Ord. 1495-96 § 3(part), 1996).
