A. Every person under first conviction under this section shall be punished by a fine of not more than two hundred fifty dollars, none of which shall be deferred or suspended.
B. A second conviction under this section shall be punished by a fine of not less than two hundred fifty dollars nor more than five hundred dollars and imprisonment for not more than ninety days, and shall not be suspended or deferred.
C. A third or subsequent conviction under this section shall be punished by a fine of not less than five hundred dollars and imprisonment for not less than forty-eight hours and not more than ninety days, none of which shall be suspended or deferred. (Ord. 1618-2000 § 2(part), 1999).
