Chapter 13.14 FATS, OILS AND GREASE
13.14.140 Penalties for violations.
A. In cases where grease interceptors are found to be inadequate due to
undersizing, blockages that have occurred more than once, or the systems are not
in place, or in compliance with this chapter, the city shall have the option to
discontinue or revoke the business license to the responsible
establishment.
B. Business license may be discontinued ninety days following
the receipt of the notice of noncompliance, if the user has not submitted
technical drawings or any other evidence that the noncompliance is being
corrected.
C. Late fees will be charged by the city according to Chapter
3.20 for nonpayment of the surcharge over the thirty days past due.
D. Any
user convicted of a violation of this chapter shall be punished, pursuant to
NMSA 3-17-1c(3) and city code Section 1.24.030(B)(3), to pay a fine of not more
than nine hundred ninety-nine dollars or shall be imprisoned in the county jail
for not more than ninety days, or shall be sentenced to both such fine and
imprisonment. Every day this chapter is violated shall constitute a separate
offense. The conviction and punishment of any user for a violation shall not
excuse or exempt such user from the payment of any fee due or unpaid at the time
of such conviction. (Ord. 1485-95 § 2(part), 1995).
