Chapter 12.12 SIGNS, BILLBOARDS AND OVERHANGING STRUCTURES
12.12.260 Enforcement responsibility.
A. The duties of the department of building safety shall include not only
the issuance of permits as required in this chapter, but also the responsibility
of insuring that all signs comply with this chapter and any other applicable
law, and that all signs for which a permit is required do in fact have a permit.
The department of building safety shall make such inspections as may be
necessary and initiate appropriate action to bring about compliance with this
chapter and other applicable law if such inspection discloses any instance of
noncompliance. The department of building safety shall investigate thoroughly
any complaints of alleged violations of this chapter.
B. Upon notice and
issuance of a red tag evidencing noncompliance from the department of building
safety, work on any sign that is being conducted in a manner contrary to the
provisions of this chapter and any other applicable law or is being conducted in
a dangerous or unsafe manner shall be immediately stopped. Such red tag notice
shall be followed by a written notice and shall be given to the permittee, if
any, the owner of the property or to the person doing the work, and shall state
the conditions under which work may be resumed. Where any emergency exists,
written notice shall not be required to be given by the department of building
safety. The department of building safety shall revoke any permit issued for
the work covered by such red tag, unless the cause of the red tag is corrected.
