12.12.140 Nonconforming signs.

A. Any existing sign or structure which violates or does not conform to the provisions of this chapter is considered nonconforming. Nonconforming signs and structures may continue in place as long as the following conditions are met and the provisions of the amortization schedule is met:
1. The nonconforming sign is registered by the owner with the building inspector on/or before May 1, 1989;
2. No change in business, ownership or use occurs;
3. The sign remains in good condition and repair;
4. No repair or alteration to exceed thirty percent of the sign replacement cost may be made. The sign must be brought into conformance or removed if repair or alteration exceeds thirty percent of the sign replacement cost.
B. Any nonconforming sign as defined in this chapter may be continued in use for a reasonable period of time not to exceed the appropriate amortization provision. This provision shall be based on replacement cost of the sign as of May 1, 1989, to determine the length of time for which the sign can remain in place with a maximum amortization of five years. However, no certificate of an engineer or architect shall be required for established signs in existence at the time of enactment of this ordinance. Replacement cost will be computed for the building inspector based on current market rate data for the area.
