12.10.030 Citation--Lien on property--Remedies cumulative.

A. Should any owner, occupant or lessee of the real property fail to meet the requirements of this chapter:
1. The city manager may cause a citation to be issued to the offending party for violation of this section, in the manner prescribed by Section 2.32.030; or
2. In instances where the city has caused the obstruction to be abated at city expense, the city clerk may prepare a claim of lien against the tract of real property involved, in such form as may be satisfactory to him, and shall file such claim of lien as an encumbrance against such tract of real property in the office of the county clerk of Curry County, New Mexico. Such lien, when filed and recorded, shall constitute a first and paramount lien against the tract of real property, subject only to the priority of the general property tax.
B. The remedies prescribed in this section shall be considered cumulative, and the exercise of one of such remedies shall not preclude the city from pursuing any other remedy. (Ord. 1265-85 § 4, 1985).
