No person shall make an excavation as defined in Section 12.06.020(D) in a street without first obtaining an excavation permit. No permit shall be required:
A. For excavations by utilities and cable television companies, except for contractors performing work for them; or
B. Excavations made in the event of an emergency; provided, however, that any person making an emergency excavation in a paved street must obtain an excavation permit during the first working day immediately following the date of the commencement of the excavation. (Ord. 1583-98 § 3(part), 1998).
