When used in this chapter, the following terms shall be deemed to have the following meanings:
A. “Applicant” means both the owner/occupant of real estate adjacent to a street or alley for whose benefit an excavation is to be made, and the licensed contractor performing the excavation; and any person authorized by this chapter to make an excavation without permit.
B. “City” means the city of Clovis, New Mexico.
C. “Director” means the city’s director of public works.
D. “Excavation” means any hole, trench, ditch or depression which penetrates through the surface of a street, and which results from the removal or disruption of pavement, dirt or other materials, including the placement of paving, asphalt, concrete, caliche or other material to the surface of the street.
E. “Person” means any individual, partnership, corporation, firm or association.
F. “Street” means the improved portion of any street, highway, alley, avenue, or other public way in the city. (Ord. 1583-98 § 3(part), 1998).
