8.04.060 Collection--Quarterly fees and liens.

The collection and disposal fees shall be payable quarterly in advance. The beginning dates of all quarterly periods shall be determined by the city treasurer. In the event the owner, occupant, or lessee of any tract of real property shall fail or refuse to pay the fees imposed by Chapter 8.04 within thirty days of the billing date, then and in that event the city manager shall cause a notice concerning such failure or refusal to be prepared on a form satisfactory to him. Such notice shall be served by delivery or by mailing to the owner, occupant, or lessee of the tract of real property involved, or in the event the whereabouts of such owner, occupant or lessee cannot be ascertained, by posting notice in a prominent place upon the tract of real property involved. In the event the owner, occupant or lessee of the tract described in the notice shall fail to pay all fees then due, within five days after the delivery, mailing or posting of such notice, then and in that event, the city clerk shall, within six months thereafter, prepare a claim of lien against the tract of real property involved, in such form as may be satisfactory to him, and shall file such claim of lien as an encumbrance against such tract of real property in the office of the county clerk of Curry County, New Mexico. Such lien, when filed and recorded, shall constitute a first and paramount lien against such tract of real property, subject only to the priority of the general property tax.
