Chapter 2.44 PLANNING-ZONING COMMISSION*
2.44.060 Powers and duties-Fencing variance authority.
In addition to those powers granted by Section 2.44.040, the
planning-zoning commission is authorized to vary the requirements of Sections
15.44.020 and 15.44.030, pertaining to fences, in any subdivision approved by
the planning-zoning commission pursuant to its subdivision regulations. No
variance of fencing requirements shall become effective until after a public
hearing at which all parties in interest and citizens shall have an opportunity
to be heard. Notice of the time and place of the public hearing shall be
published one time in a newspaper of general circulation within the city at
least fifteen days prior to the date of any variance. The commission, upon
authorizing a variance to fencing requirements within any subdivision, shall
require the subdivider to insert the terms of the variance in the protective
covenants and restrictions for that subdivision, and shall require that the
protective covenants and restrictions be recorded in the office of the county
clerk of Curry County as a public record. (Ord. 1086-77 § 2, 1977: prior
