Pursuant to the authority contained in section 38-1-3, New Mexico Statutes 1953 Annotated, any duly appointed official or employee of the city entrusted with enforcement of any of the ordinances specified in Section 2.32.010 shall have the same power possessed by police officers of the city to issue citations in the same manner and with the same force and effect as citations issued by police officers, but such citations shall relate only to those offenses mentioned in Section 2.32.010 and no city official or employee other than a police officer shall physically arrest or take into custody any violator except on a warrant duly issued. In no event shall a citation be issued for any offense constituting a breach of the peace. (Prior code § 2-49).
