Chapter 1.12 VARIANCES FROM CITY REGULATIONS
1.12.050 Procedure for cancellation.
A. A variance may be canceled and removed for the following
reasons:
1. The use authorized by the variance is
discontinued;
2. The circumstances have changed to such a degree that the
variance is no longer appropriate; and
3. The individual who received the variance, or a successor
in interest, has violated or refused to comply with conditions established on
the exercise of the variance.
B. The inspection and planning department shall send
notification of the proposed cancellation by certified mail to the property
owner or involved entity. The cancellation will be effective if the property
owner does not declare objection to the proposed action in writing within
forty-five days. If a notice of objection is received, the issue will be placed
on the agenda of the Clovis city commission for final determination. (Ord. 1413
§ 3, 1992).
