What is Code Compliance?

The Code Compliance Division of Building Safety consists of four officers, the Environmental Response Team (ERT), and a supervisor. Each officer is assigned one of the four “zones” within Clovis, separated by 14th Street and Prince Street. The assigned Code Officer will work inside their zone proactively and response citizen compliants for weeds and debris, public nuisances, and abandoned/inoperable vehicles in voilation of the City code. The Environmental Response Team (ERT) is comprised of a three-person crew responsible for the abatement of properties. ERT works with the Code Compliance Officer’s work order to remove tall weeds/grass, debris, refuse, srap piles, tires, etc. from properties/cases that have failed to meet the standards and/or deadlines for compliance as described by City ordinances and Zone Officer’s inspections. The three most commonly violated ordinances within city limits are: 8.08 PUBLIC NUISANCE 8.16 WEED AND DEBRIS CONTROL 10.08 ABANDONED VEHICLES

Graffiti Removal

The City of Clovis’ Environmental Response Team (ERT) handles the removal of graffiti at NO COST to the citizens of Clovis. Frequently Asked Questions

Q: How many letters are sent for a code violation?
A: ONE. Upon determining that a public nuisance exists on private property and that there is a danger to the public health, safety, peace or general welfare, the Code Compliance Division shall cause a notice to be delivered to the owner and occupant of the private property where the public nuisance exists or upon the person causing, permitting or maintaining such nuisance, if such owner, occupant or person causing the nuisance can be found, and shall post a copy of the notice on the premises where the public nuisance exists. Such notice shall also state that a failure of such owner, occupant or person to abate or remove the nuisance as required by such notice shall be deemed an implied consent for the city to abate or remove the nuisance. The implied consent shall be deemed a form of a contract between the owner, occupant or person and the city. If the public nuisance does not constitute a great or immediate danger to the public health, safety or welfare the department of building safety may serve the owner or occupant of such premises or the person in whose name such real estate was last billed for property tax purposes, a notice to demand the abatement or removal of the violation within five business working days. In the event a second notice of the same or similar nuisance condition for a property is given within a twelve-month period, the abatement time may be reduced to two business working days.

Q: Can I get more time than what is stated in the Notice of Violation letter to take care of the violation?
A: In most cases, yes. You will need to speak with the Code Officer who sent you the letter. They can be contacted at the phone number listed on the letter. If you show progress in complying, the Code Officer should work with you.

Q: I received a letter for rubbish and trash but, I didn’t put it there. Am I still responsible?
A: Yes. A property owner is responsible for any violations on their property.

Q: I have large items to dispose of and have no means of hauling items to landfill, who do I contact?
A: If you have the means to take your items to the landfill, City residents may do so FREE of charge! However, if you do not have the means to do so, place items behind your fence and call 575-769-2376 (Public Works) and request items to be picked up.

Q: The dumpster is located behind my property and people keep piling trash/junk/debris around/next to the dumpster. What am I supposed to do?
A: Call Public Works @ 769-2376 or use SeeClickFix to submit request to have items picked up.

Q: I have a tenant living in a property that I own. Can I get a fine for their violation of an ordinance?

A: Citations for noncompliance may be issued to the owner/renter/leasee. However, notices are mailed to the owner of record @ the Curry County Tax Assessor’s Office. If the City has to bring the property into compliance, the bill for same will be the responsibility of the owner of record and the Curry County Assessor’s Office.

Q: Is there an ordinance prohibiting the parking of vehicles in a back yard?
A: No. However, vehicles parked in the driveway, front yard, side yard & street/alleyway MUST not fit the definition of a “Junk Vehicle” which is: A. Is partially dismantled or wrecked; or B. Cannot safely and legally be operated on the public streets and highways; or C. Remains inoperable for a continuous period of thirty days. If vehicle meets any of the 3 above criteria, it is considered a “junk vehicle” and is in violation of City Code!

Q: There is a vehicle on my property that doesn’t belong to me, how do I get it removed?
A: You would need to contact a tow company to remove vehicle(s) from your property.

Q: Can Code Enforcement Officers look over a fence to inspect a complaint?

A: It depends on what the complaint is about. They can’t look over by standing on/in bed of pickup truck, etc. (sometimes weeds/growth can be observed over the top of a solid fence). However, Code Officers can inspect properties for possible City Code Violations from public ways (streets, easements & alleys), or another property with the property owner’s consent.

Q: Is a property owner or tenant responsible for mowing the alley?
A: Yes. Each property owner or tenant is responsible for keeping the alley cleaned and mowed to the midpoint of the alley.

Q: Can Code Enforcement tell my neighbor to cut their tree limbs that are hanging over onto my property?
A: No. That would be a civil matter between you and your neighbor.

Q: Is there an ordinance requiring the removal of dead trees?
A: No. There is no ordinance requiring the removal of dead trees-only the removal of tree limbs that are on the ground.

Q: Who do I contact regarding an inoperable vehicle on the street?

Q: Who do I contact regarding grass being blown onto streets?
A: Regulation of organic waste has been removed from City Code. Please contact the Public Works at 575-769-2376 to request a street sweeper.

Q: What area is considered the right-of-way?
A: The actual area that is right-of-way varies due to many factors. In order to try and provide a consistent answer for the purposes of sign placement, The City of Clovis, NM generally defines the right-of-way as the area starting at the back of the curb and extending in some areas up to 10+ feet inward into the property. Temporary signs should be placed at least FIVE (5) feet behind the backside of the curb or edge of pavement.

Q: Who do I contact for vehicles that are parked blocking an alley?

Q: What are the requirements to place a shipping container (conex box) on my property?
A: Shipping containers are considered a storage building and a building permit is required to place one of 120 SqFt on a property. Contact Building Inspections for information on the permitting process at 575-763-9611.
